Hon. James Klein, Retired District Court Judge - Home Home About Contact Mediation, Arbitration and Court Services 4450 Arapahoe Avenue, Suite 100, Boulder Colorado 80303 303-667-7891 Contact me now The best solution to any dispute is one reached between the parties with the assistance of a knowledgeable mediator. Although Judge Klein understands that each dispute presents a unique set of facts and challenges, he is a firm believer that people can most often find resolution to their problems given the opportunity in a confidential setting where honest discussion and problem solving can occur. Finding common ground in some disputes is simply impossible to find. Understanding that our current judicial system can be time consuming, expensive, and stressful, Judge Klein offers his services as an arbitrator and section 13-3-111, CRS, Judge Pro Tem, allowing the parties a full resolution that is inexpensive and prompt. Mediation Mediation is a confidential and voluntary process that brings parties together to resolve their differences through discussion and problem-solving. The mediator acts as a neutral third party who helps facilitate the dialogue but is not the final decision-maker, arbitrator, or judge. Mediation can resolve disputes quickly and satisfactorily without the expense, delay and anxiety of litigation. By offering a neutral and confidential environment for parties to express their needs and interests, discuss options and reach a mutually agreeable resolution, mediation can preserve important relationships. Mediators can assist with understanding and analysis of legal issues, facts, and share their experience of what judges and juries may do with a case. This process helps parties understand their cases and make good decisions. Arbitration ?Arbitration is a more formal process during with the Arbitrator acts as a judge of the facts and law. The dispute is submitted to an neutral Arbitrator who will make an "award." Awards are made in writing and are generally final and binding on the parties in the case. ?Arbitration are governed by the terms of the contracts that the parties have signed and various procedural rules. Judge Klein is an an approved mediator and arbitrator with AAA, the oldest Arbitration service in the United States. Court Appointments Colorado Law permits parties to retain a private judge under Colorado Revised Statute 13-3-111. When the parties agree on the private judge, the proceedings are held pursuant to the Colorado Rules of Civil Procedure, and the cases advances as it would if it were presided over by a sitting State Court Judge. The benefit is that the private judge has a more flexible schedule, and disputes can be resolved more quickly. Additionally, sitting State Court Judges, in complicated matters, can appoint private judges to act as Special Masters and Discovery Masters. Judge Klein conducts private Judge pro tem matters and serves as a special master at the direction of the District Court. ?
